Terms of Use of the Driving Experience (Seller Training)
The Volkswagen Seller Training Portal (hereinafter referred to as the “Portal”) is offered by VOLKSWAGEN AG, Berliner Ring 2, 38440 Wolfsburg, Germany, registered in the Commercial Register of the Local Court of Braunschweig under the number HRB 100484 (VOLKSWAGEN AG) (hereinafter referred to as “VOLKSWAGEN AG”).
These Terms of Use govern the rights and obligations during the use of the Driving Experience (hereinafter referred to as “Seller Training”) in the context of the market launch of the new Volkswagen vehicle (hereinafter referred to as “VW Vehicle”) on the Portal.
The salesperson training is a digital sales training course that is primarily intended to qualify new car sellers within the European Economic Area for sales in terms of content as part of the market launch of the Volkswagen vehicle. In addition, other participants in the stores or Volkswagen AG can use the portal for information about the new Volkswagen vehicle. The prerequisite for this is a Group Retail Portal access with the role activated for the sales training. The portal is used for an interactive knowledge transfer and query (hereinafter referred to as “knowledge review”) for the market launch of the Volkswagen vehicle.
Insofar as personal data is collected and processed, this is done exclusively within the framework of the data protection declaration
1. Authorized Persons and Access Eligibility
Only users (hereinafter referred to as “users”) who have a valid Group Retail Portal (hereinafter referred to as “GRP”) login access and whose GRP role has been activated by the importer or VOLKSWAGEN AG for sales training are entitled to use.
2. Functions and purpose of the portal
a. After the user has successfully logged in to the portal, he or she has the opportunity to take part in a digital sales training course in the form of an interactive knowledge transfer consisting of various learning contents, product information in the form of various media (including texts, images, videos, etc.), and a knowledge check on the market launch of the Volkswagen vehicle.
b. The user has the option of making a note of the content that is of interest to him and calling it up via the dashboard during a repeated training session (so-called bookmark function). The required data will be kept until the defined end of the training and then removed as provided for in the deletion period.
c. As part of the salesperson training, the user completes various mandatory modules and takes part in a mandatory knowledge test integrated into the salesperson training to check the learning success.
d. After the first complete completion of all training content, the opening and closing as well as the integrated knowledge check, the user can then click through the entire training content of the portal as often as desired and repeat learning content.
e. At the end of the training, there is the possibility of an anonymous survey. For this purpose, feedback on the training components (content and structure) is asked via 15 questions (star rating 1 to 5). In addition, the anonymized survey offers the opportunity to provide additional feedback via two free text fields. The evaluation of the anonymized survey only takes place as a market/country comparison and is used to analyze the improvement of training quality.
3. Knowledge Assessment Process
a. All users of the sales training take part in several knowledge checks integrated into the training modules, in which they answer questions about the learning content.
b. A training module may include several knowledge checks. A knowledge check consists of several questions. Some questions have one correct answer and others have several correct answers.
c. A knowledge check is considered complete when at least 65% of the questions per test have been answered correctly.
d. Each participant can go through the knowledge check multiple times until all checks are successfully completed.
e. The chapters and learning content do not have to be worked on sequentially.
4. User’s right of use and obligations of conduct
a) The User is granted the non-exclusive, non-transferable and non-sublicensable right to use the Portal or parts thereof in accordance with these Terms of Use. In particular, the User undertakes not to copy, duplicate, otherwise reproduce, transmit to third parties or distribute the content presented on the Portal.
b) The user must ensure that he or she does not violate applicable legal provisions or violate the rights of third parties.
c) When using the portal, copyright, name and trademark rights as well as other intellectual property rights of VOLKSWAGEN AG as well as the rights of third parties must be observed. Among other things, the images, films, audio files, music, documents and trademarks such as “VOLKSWAGEN AG”, “ID” and “Golf” presented by VOLKSWAGEN AG are protected. The accessibility of the portal does not grant any license or other right of use thereto.
d) Access to the portal is non-transferable. The user may not pass on his access data to other employees or third parties or make them accessible to them.
e) Any improper use of the portal must be refrained from, in particular:
- Â no safety precautions are circumvented,
- no equipment is used or applications are run that could lead to damage to the equipment or to a functional failure, in particular due to changes to the physical or logical structure of the servers or the network of VOLKSWAGEN AG or other networks,
- Parts of the portal may not be integrated into other websites, neither private nor commercial.
f) VOLKSWAGEN AG is entitled to revoke the user’s access authorisation at any time. This is particularly the case if the User violates these Terms of Use. Upon withdrawal of the access authorisation, the user may no longer use the portal.
5. Liability
a) VOLKSWAGEN AG shall be liable without limitation if the cause of the damage is due to intent or gross negligence. Furthermore, the organiser is liable for the slightly negligent breach of essential obligations, the breach of which jeopardises the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which is essential for the proper execution of the event in the first place and on the observance of which the users regularly rely (cardinal obligations). In this case, however, the organiser is only liable for the foreseeable damage typical of the contract. The organizer is not liable for the slightly negligent violation of obligations other than those mentioned in the preceding sentences.
b) The above limitations of liability do not apply in the event of injury to life, limb or health. Liability under the Product Liability Act remains unaffected. Insofar as the liability of VOLKSWAGEN AG is excluded or limited, this also applies to the personal liability of its employees, representatives and vicarious agents.
6. Other
a) VOLKSWAGEN AG may amend these Terms of Use from time to time with effect for the future. Changes to these terms and conditions shall take effect vis-Ã -vis the User if the changes have been communicated to the User, if the User does not object within two weeks of the notification and if VOLKSWAGEN AG has expressly informed the User of this consequence in the notification of the change. If the user objects to the changes within the deadline, the changes will not be effective against the user.
b) The Terms of Use and the entire legal relationship between the Users and VOLKSWAGEN AG are subject exclusively to the laws of the Federal Republic of Germany to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
c) The exclusive place of jurisdiction for all claims arising from and in connection with these Terms and Conditions of Participation is Wolfsburg, Germany, if the user is a merchant.
d) Legal recourse is excluded.
